These Terms of Use (the “Terms”) govern your access to and use of www.finadvantage.com (the “Website”) operated by FinAdvantage Consultancy Private Limited and its affiliates (collectively, “FinAdvantage”, “we”, “us”, or “our”). By accessing or using the Website, you (“you”, “your”, or “User”) agree to be bound by these Terms. If you do not agree, please do not use the Website.
These Terms apply to all visitors, users, and others who access or use the Website. The Website is an
informational platform that provides information about FinAdvantage’s services, insights, and the firm. The Website is not a transactional platform; engagement of professional services occurs only through separate written agreements with FinAdvantage.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and to view and print Content for personal, non-commercial reference purposes only. You may not copy, reproduce, republish, modify, distribute, transmit, display, perform, sell, or create derivative works from the Content without our prior written consent.

OR THAT ANY DEFECTS WILL BE CORRECTED.

DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER
INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR
INABILITY TO ACCESS OR USE, THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH

Certain US states, including New Jersey, do not permit the limitation of liability for certain types of damages. To the extent such limitations are prohibited by the law of your state of residence, they shall not apply to you.
You agree to defend, indemnify, and hold harmless FinAdvantage, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (a) your violation of these Terms, (b) your use or misuse of the Website, or (c) your violation of any rights of a third party.
FinAdvantage respects intellectual property rights and complies with the Digital Millennium Copyright Act
(DMCA), 17 U.S.C. § 512. If you believe that any Content on the Website infringes your copyright, please send a written notice to our designated DMCA agent at hr@finadvantage.com containing all of the following:
Upon receipt of a compliant DMCA notice, FinAdvantage will act expeditiously to remove or disable access to the allegedly infringing material. Counter-notices may be submitted in accordance with 17 U.S.C. § 512(g). Knowingly making a materially false statement in a DMCA notice may expose the sender to civil liability.
For non-US copyright infringement claims, please include: (i) a description of the copyrighted work; (ii) the URL where the allegedly infringing material appears; (iii) your contact information; (iv) a statement that you have a good-faith belief that the use is not authorised; and (v) a statement that the information is accurate and that you are the rights holder or are authorised to act on behalf of the rights holder.
To the extent FinAdvantage’s activities in connection with the Website are subject to applicable US federal and state laws, FinAdvantage operates in compliance with those laws, including as follows:
Any commercial electronic messages sent by FinAdvantage to US recipients will comply with the requirements of the CAN-SPAM Act, 15 U.S.C. § 7701 et seq., including by clearly identifying the message as a commercial communication, including a valid physical postal address, and providing a clear and conspicuous opt-out mechanism. Opt-out requests will be honoured within ten (10) business days.
The website is not directed to children under the age of 13. FinAdvantage does not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act, 15 U.S.C. § 6501 et seq. (COPPA) and the FTC’s COPPA Rule, 16 C.F.R. Part 312. If we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete it. FinAdvantage will not place automated or prerecorded calls or send automated text messages to US telephone numbers in violation of the Telephone Consumer Protection Act, 47 U.S.C. § 227. Any telephone communications by FinAdvantage will be made only with appropriate prior express consent where required by applicable law.
FinAdvantage endeavours to make the Website reasonably accessible to users with disabilities in compliance with applicable US federal and state accessibility requirements, including relevant provisions of the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq. We aim to follow the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a reference standard. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Notwithstanding the foregoing, US users acknowledge that certain mandatory consumer-protection provisions of applicable US federal and state law may apply and are not displaced by this choice-of-law provision to the extent prohibited by such laws.
Subject to the arbitration provision below, the courts at Bengaluru, Karnataka, India shall have exclusive
jurisdiction over any disputes arising out of or relating to these Terms or your use of the Website.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or
invalidity thereof shall first be attempted to be resolved through good-faith negotiation. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996, as amended. The seat and venue of arbitration shall be Bengaluru, India. The arbitration shall be conducted in English by a sole arbitrator mutually appointed by the parties. The arbitration award shall be final and binding.
To the extent permitted by applicable law, you and FinAdvantage agree to resolve any dispute on an individual basis and waive any right to bring or participate in a class action or representative proceeding. Some jurisdictions, including California, impose limitations on class-action waivers; nothing in this clause limits rights that cannot be waived under applicable mandatory law.
FinAdvantage may, in its sole discretion and without notice, suspend, restrict, or terminate your access to all or any part of the Website at any time, for any reason, including for breach of these Terms. The provisions of these Terms which by their nature are intended to survive termination shall so survive.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and FinAdvantage with respect to your use of the Website.
You may not assign or transfer these Terms; we may assign or transfer them without restriction. Any claim or cause of action arising out of or relating to your use of the Website must be filed within one (1) year after such claim or cause of action arose, or it shall be permanently barred, except to the extent a longer period is required by applicable mandatory law.
These Terms are made available in English. In the event of a conflict between an English version and a
translated version, the English version shall prevail.
